1. Agreement to Terms

By accessing or using MapLift ("Service"), operated by Brand Wisdom Solutions ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

MapLift is a competitive intelligence and local SEO optimization platform that provides:

• Google Maps business profile analysis and health scoring
• Competitive intelligence and market positioning insights
• AI-powered review template generation
• Local search optimization recommendations
• Performance tracking and analytics
• Business domination strategies for Google Maps

The Service analyzes publicly available information to provide insights and recommendations. We do not guarantee specific rankings, customer increases, or business outcomes.

3. User Accounts

To access certain features of the Service, you must create an account using Supabase authentication. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Use a valid email address for account verification

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Submit false, misleading, or fraudulent information
• Engage in unauthorized data scraping or harvesting
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to harm, threaten, or harass others
• Generate fake or misleading reviews
• Violate Google's terms of service or review policies
• Resell or redistribute the Service without authorization
• Use automated tools to access the Service (except as provided by us)

5. Subscription and Payment

Subscription Plans

MapLift offers subscription-based access with multiple tiers: Essentials (₹299), Pro (₹999), and Business (₹2999) per month. Free tier includes 5 analyses per month. Business plans include advanced features with premium pricing. Free trials or promotional periods may be offered at our discretion.

Billing

• Subscriptions automatically renew unless canceled
• Payment is due at the beginning of each billing cycle
• We accept payments through PhonePe and other supported methods
• All fees are in Indian Rupees (₹) unless otherwise stated
• Taxes may apply based on your location (GST for Indian customers)
• Payment failures may result in service suspension

Refunds

We offer a 14-day money-back guarantee for new subscriptions. After this period, payments are non-refundable except as required by law. No refunds for partial months. Refunded amounts will be credited to your original payment method within 7-14 business days from the date of refund approval.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access until the period ends. No partial refunds for early cancellation.

6. Intellectual Property Rights

Our Property

The Service, including its original content, features, and functionality, is owned by Brand Wisdom Solutions and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. MapLift™ is a trademark of Brand Wisdom Solutions.

Your Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with operating and improving the Service.

Generated Content

Review templates and insights generated by our AI are provided for your use. You may use this content for your business purposes, but you are responsible for ensuring it complies with applicable laws, platform policies, and ethical business practices.

7. Disclaimers and Limitations of Liability

No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

No Guarantee of Results

We do not guarantee specific results, including but not limited to:

• Improvements in Google Maps rankings or visibility
• Increases in customer acquisition, leads, or revenue
• Specific review ratings, volumes, or quality improvements
• Competitive advantages over other businesses
• Compliance with changing platform policies

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAND WISDOM SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or ₹10,000, whichever is lower.

8. Indemnification

You agree to indemnify, defend, and hold harmless Brand Wisdom Solutions, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service or generated content
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service
• Your business practices or customer interactions
• Any reviews or content you create using our templates

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Violation of acceptable use policies
• At our sole discretion

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that should reasonably survive termination will remain in effect.

10. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Maharashtra, India, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Indian Arbitration and Conciliation Act. The arbitration shall be conducted in Pune, Maharashtra, India.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, available at www.maplift.app/privacy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

12. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by us, including Google Maps, payment processors, and other business tools. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any such content.

13. Modifications

To the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

To the Terms

We may revise these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or through the Service at least 7 days before they take effect.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Brand Wisdom Solutions concerning the Service and supersede all prior agreements.
